Subscription and Billing Terms

⚠️ Notice: Contractual document for paid plans and billing cycle. Requires legal review before use with paying customers.


1. Subject matter

This document governs the commercial and financial conditions of paid subscriptions to the iBetterCoach Platform, complementing the Terms of Use, the Refund Policy and the SLA.

It applies to all Professional Customers and B2B clients who contract any paid plan.


2. Available plans

iBetterCoach offers different subscription plans, whose detailed description (included features, usage limits, price) is always up to date at [URL]/pricing.

The following plans are currently envisaged (subject to evolution):

iBetterCoach reserves the right to create, modify or discontinue plans, maintaining the conditions in force for already-subscribed Customers during their respective contracted period.


3. Prices and taxes

3.1 Currency

Prices are displayed in EUR (euros). For customers outside the eurozone, conversion is performed by the payment provider (Stripe) at the exchange rate applied on the charge date.

3.2 VAT

Prices displayed for consumers already include VAT at the rate in force in Portugal (currently 23%, subject to legislative changes).

Prices displayed for professionals with a valid intra-community VAT number (verifiable via VIES) are shown without VAT, under the reverse charge regime of the Portuguese VAT Code.

iBetterCoach issues electronic invoices valid under the VAT Code, communicated to the Portuguese Tax Authority where applicable.

3.3 Price changes

iBetterCoach may update prices at any time, with at least 60 days' prior notice by email to existing Customers. Increases only apply:

  • For monthly subscriptions: at the next renewal after the notice period ends
  • For annual subscriptions: at the next annual renewal

A Customer who disagrees with the increase may cancel the subscription before its entry into force without penalty.


4. Billing cycle

4.1 Frequency

  • Monthly: charged on the same day each month (or last day of the month if no equivalent day exists)
  • Annual: charged annually in advance, with a discount over the monthly plan

4.2 Start

The first charge occurs on the activation date of the paid subscription. For Customers starting after a trial, the charge occurs at the end of the trial period, unless cancelled in advance.

4.3 Automatic renewal

All paid subscriptions renew automatically at the end of each period. The Customer may cancel renewal at any time through their personal area.

For annual subscriptions, iBetterCoach notifies by email 15 days in advance of automatic renewal, in line with consumer protection best practices.

4.4 Receipts

After each charge, the Customer receives the corresponding electronic invoice by email, also available in the Platform's personal area.


5. Means of payment

5.1 Accepted

  • Credit and debit cards (Visa, Mastercard, American Express)
  • SEPA Direct Debit
  • Apple Pay / Google Pay
  • Other means provided via Stripe

5.2 Processing

Payments are processed by the certified provider Stripe Payments Europe Ltd., under its own terms (https://stripe.com/legal). iBetterCoach does not store card data (PAN). Data are tokenised by Stripe.

5.3 Payment failure

In case of failure (expired card, insufficient funds, bank refusal):

  1. iBetterCoach notifies the Customer by email
  2. Attempts a new automatic charge in 3 to 7 days
  3. After 15 days without regularisation, suspends paid features
  4. After 30 days without regularisation, terminates the subscription (data preserved for a further 30 days to allow reactivation)

iBetterCoach may charge late payment interest under Article 102 of the Portuguese Commercial Code and DL 62/2013 for B2B customers in prolonged default.


6. Upgrades and downgrades

6.1 Upgrade

The Customer may upgrade to a higher plan at any time. The price difference is calculated proportionally to the remaining period and charged immediately (or credited as bonus).

6.2 Downgrade

The Customer may downgrade to a lower plan. The downgrade takes effect at the end of the billing period already paid. No refund is generated.


7. Promotional coupons and discounts

iBetterCoach may offer coupons, promo codes or time-limited discounts. The conditions of each promotion are specific and communicated at the time of the offer.

Coupons:

  • Are not cumulative with each other, unless expressly stated
  • Cannot be converted into cash
  • Have an expiration date indicated
  • iBetterCoach reserves the right to cancel promotions in case of abusive or fraudulent use

8. Refunds

Refunds are governed by the Refund Policy (document 08).


9. Billing disputes

In case of an incorrect charge, the Customer must contact support@ibettercoach.com within 30 days after the invoice. iBetterCoach reviews and responds within 5 business days.

Bank chargebacks initiated without prior contact may result in account suspension for investigation.


10. Suspension and termination for breach

iBetterCoach may suspend or terminate the account of a Customer who:

  • Does not pay invoices when due
  • Breaches the Terms of Use or the Acceptable Use Policy
  • Uses the Platform for unlawful purposes
  • Engages in conduct that endangers the integrity of the service or other users

Suspension is always preceded by notification to the Customer, except in cases of imminent risk.


11. Account closure by the Customer

The Customer may cancel their account at any time through the personal area settings. Cancellation:

  • Takes effect at the end of the paid period
  • Keeps data available for 30 days for export
  • After 30 days, data are deleted under the DPA, except for legal retention

12. Governing law and jurisdiction

These Subscription Terms are governed by Portuguese law. Without prejudice to mandatory consumer rights, the competent jurisdiction is the courts of [TBD].
